These terms describe how text messages and other messages are sent by and through Warmd. They serve three audiences: people who opted in to texts from Warmd itself, on our website or in the app (Section 1), consumers who received a message from a business that uses the platform (Sections 2 to 4), and businesses that use the platform to send them (Section 5). This page is the public program description referenced in our messaging registrations.
1. Warmd SMS program
Program name: Warmd Updates & Support (the “Program”), operated by Warm'd LLC (“Warmd”). This section covers text messages Warmd itself sends, from its own number, to people who opted in on warmd.ai or in the Warmd app. Messages that other businesses send using the Warmd platform are covered in Section 2.
How you opt in. There are two ways, and each is optional.
On our website. You opt in by entering your mobile number on the text updates form at https://warmd.ai/text-updates and checking one or both of two separate, optional SMS consent boxes: one for account and service texts, and one for marketing texts. Neither box is ever pre-checked, and you can check either one without the other. Consent is not a condition of joining the waitlist, of creating an account, or of any purchase; you can join the waitlist with an email address alone.
In the app. If you are a member of a workspace on Warmd (its owner or a teammate), you opt in by adding your own mobile number in the app and confirming it with the six digit code we text to that number. The screen states what you are agreeing to before you save the number, and nothing but that code is texted to a number until it is confirmed. Adding a mobile number is never required: an account works without one, and consent is not a condition of any purchase.
What we send. If you check the account and service box: waitlist and demo-request follow-ups; account, onboarding, and service notifications; and conversational replies when you text us. If you check the marketing box: product updates, launch announcements, and occasional promotional messages about Warmd. We send marketing texts only to people who checked the marketing box. If you confirmed a mobile number in the app: the code that confirms it, test messages you send to yourself, and the account notifications you turned on by text in Settings (for example a new lead, a booked appointment, or a question from your agent). You choose which notifications are texted, and can turn each one off there. Messages may be sent using automated technology, and some replies may be drafted by an AI assistant; you can ask for a human at any time.
Message frequency varies based on your activity and requests. Message and data rates may apply, depending on your mobile plan.
Opt out. Reply STOP to any message (END, QUIT, CANCEL, UNSUBSCRIBE, STOPALL, REVOKE, and OPTOUT also work). You will receive one confirmation and no further messages. Reply START to rejoin. A member can also turn texts off in Settings, or remove the mobile number there.
Help. Reply HELP to any message, or email admin@warmd.ai.
Eligibility. You must be 18 or older and the account holder of, or authorized to use, the mobile number you provide. If you change or give up your number, tell us so we can remove it.
Carriers. The Program works on major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
Privacy. We do not sell, rent, or share mobile numbers or SMS opt-in data and consent with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
Changes and contact. We may update or end the Program; material changes will be posted here. Warm'd LLC, 7901 4th St N, Ste 300, St. Petersburg, FL 33702 · admin@warmd.ai.
2. If a business using Warmd messaged you
A business you contacted, requested information from, or otherwise gave your number to is using Warmd to follow up with you. Warmd is the software; the business is the sender. The message identifies which business it is on your behalf.
To stop: reply STOP, END, QUIT, UNSUBSCRIBE, CANCEL, STOPALL, REVOKE, or OPTOUT to any text message. You may also simply tell the agent, in your own words, that you do not want to be contacted. The system recognizes ordinary language, not only keywords. You will receive one confirmation message and then nothing further.
To get help: reply HELP to any message, or contact admin@warmd.ai.
Message frequency varies by business and by conversation; these are conversational follow-ups, not a fixed broadcast schedule. Message and data rates may apply according to your mobile plan. Carriers are not liable for delayed or undelivered messages.
Opt-outs are honored across every channel (texts, email, and chat), not only the one you used, and they are permanent unless you reply START or ask the business to reverse them.
3. Conversations are handled by AI
Messages are written and answered by an AI agent. It will tell you it is an AI if you ask. It is not a human, and it does not pretend to be one.
To generate replies, the content of the conversation is sent to the AI providers listed on our Subprocessors page, under terms that prohibit them from using it to train their models. Conversations are retained as described in our Privacy Policy.
You can ask the agent to connect you to a human at any time, and it will notify the business.
4. Rules the platform enforces on every send
These controls run on every outbound message and cannot be disabled by the business using the platform:
- Quiet hours. Nothing is sent outside 8:00 a.m. to 9:00 p.m. in the recipient’s local time. Where the time zone cannot be determined, the system sends only during hours that are legal in every continental U.S. time zone. Florida and Oklahoma are restricted to 8:00 a.m. to 8:00 p.m.
- Daily attempt caps in states that impose them, currently Florida, Oklahoma, and Washington (three attempts per 24 hours).
- Consent gating. Channels are blocked where the recorded consent basis is insufficient for that channel. Marketing texts sent with automated technology require prior express written consent.
- Suppression and Do-Not-Call screening before every attempt.
- Mandatory AI identification, inserted into the agent’s instructions by us and not editable by the business.
- An append-only audit record of every attempt, the rules applied, and the outcome.
5. If you are a business using the platform
You are the sender for legal purposes. Before enabling any channel you must:
- complete A2P 10DLC brand and campaign registration truthfully, and keep your traffic consistent with the registered use case;
- hold consent appropriate to each channel and purpose, including prior express written consent for marketing texts sent using an automated system;
- display, at the point of consent collection, a clear disclosure that the consumer agrees to receive automated texts from your business, that consent is not a condition of purchase, and that message and data rates may apply, with links to this page and to the Privacy Policy;
- maintain your own Do-Not-Call policy and honor opt-outs received outside the platform by importing them as suppressions;
- identify your business clearly in outbound communications and never misrepresent who is contacting the consumer.
The platform’s controls reduce risk; they do not transfer it. The consent you attest to is the one input we cannot verify, and liability for contacting a consumer without it is yours. See Section 6 of the Terms of Service.
6. Supported carriers and disclaimers
Messaging is supported on major U.S. carriers. Carrier participation can change, and carriers may filter or block traffic at their discretion. Neither Warmd nor any carrier is liable for delayed, filtered, or undelivered messages.
