This Acceptable Use Policy (“AUP”) is part of the Terms of Service and applies to everyone who uses Warmd. We enforce it to protect consumers, to keep our messaging infrastructure in good standing with carriers, and to keep the platform lawful for every customer on it.
1. Consent is the whole rule
Every contact the platform makes on your behalf must rest on consent you actually obtained and can prove. You may not:
- upload purchased, scraped, harvested, rented, or otherwise third-party-sourced contact lists where the consumer did not consent to contact from your business specifically;
- attest to a consent basis you do not hold, or classify a lead source more favorably than the facts support;
- contact a person who has opted out, or re-upload, re-import, or re-key a suppressed contact to circumvent suppression;
- contact numbers on a Do-Not-Call registry without a valid written-consent or established-business-relationship exemption;
- use another business’s consent as if it were your own, including consent obtained by a lead vendor for a different seller.
2. Prohibited outreach categories
Regardless of consent, you may not use the platform for messaging that carriers prohibit under industry messaging standards, including:
- high-risk financial offers: payday, short-term or high-interest loans, debt collection, debt consolidation or forgiveness, credit repair, and get-rich-quick or investment-return schemes;
- cannabis, CBD, kratom, tobacco, vaping, alcohol delivery, and controlled substances, including any depiction or facilitation thereof;
- firearms, ammunition, explosives, fireworks, and weapon accessories;
- gambling, sweepstakes, lotteries, and contests;
- adult content, sexual services, and dating services of an explicit nature;
- prescription medication offers, illegal or unapproved health products, and unsubstantiated health or cure claims;
- multi-level marketing, pyramid schemes, affiliate-lead resale, and “work from home” income-claim offers;
- phishing, credential harvesting, malware distribution, and fraud of any kind;
- political campaigning, electioneering, and issue advocacy, which carry separate registration regimes this platform does not implement.
3. AI conduct
You may not configure, prompt, or otherwise attempt to make the agent:
- deny that it is an AI, claim to be human, or evade a direct question about what it is;
- impersonate a specific real person, another business, a government agency, or a regulator;
- omit, weaken, or talk around a legally required AI-identification disclosure;
- state prices, guarantees, coverage, approvals, or legal, medical, or financial advice that your business is not authorized to give;
- pressure, harass, threaten, or repeatedly re-contact a person who has declined.
4. Platform integrity
You may not:
- attempt to access another customer’s data, probe for tenant isolation flaws outside a good-faith security report, or bypass authentication, rate limits, or usage caps;
- spoof, falsify, or obscure originating identification on messages;
- distribute traffic across numbers or accounts to evade carrier filtering, registration requirements, or volume limits (“snowshoeing”);
- resell, sublicense, or provide the Service to third parties as your own without a written reseller agreement;
- use automated means to scrape the Service, or use it to build a competing product;
- interfere with the operation of the Service or transmit malicious code.
5. Enforcement
We may investigate suspected violations and may suspend or terminate access, disable a campaign or number, or remove content. Where practicable we give notice and an opportunity to correct, but messaging-abuse and consent violations are acted on immediately and without a cure period, because carrier-level consequences fall on the whole platform and consumer harm cannot be undone after the fact.
We may report unlawful conduct to carriers, regulators, or law enforcement. Termination under this AUP does not entitle you to a refund.
Report suspected abuse to admin@warmd.ai.
